August 14, 2014 by Kevin Mahoney

If you drive long enough chances are very good that you will eventually get a traffic ticket. Even if you are a law abiding citizen and do your best to obey all the rules of the road, you could still end up in the cross-hairs of a radar gun or in the sights of an overzealous law enforcement officer one day. If that occurs, you can simply pay the ticket and move on or challenge the ticket. Before deciding how to handle your ticket you should consider what happens if you take a ticket to trial and … [Read more...]

Understanding the Federal Sentencing Guidelines

In the United States an individual can be charged with a state crime, a federal crime, or both. The federal criminal justice system operates in much the same way as the individual state criminal justice systems; however, there are some noticeable differences. For example, the federal system tends to be much more formal than many state systems. One aspect of the federal system that is not found in all state systems is the use of sentencing guidelines. If you have been charged with a federal … [Read more...]

Examining Potential Issues for Appealing in a Criminal Conviction?

July 13, 2014 by Kevin Mahoney

Because most people have never been through a criminal trial, much less an appeal, there are a variety of misconceptions about the appellate process. If you plan to pursue an appeal, you may wish to learn more about the types of issues you may attack on appeal in a criminal case.First, a basic understanding of the purpose and goal of an appeal is necessary. An appeal is not another opportunity to try your case. Except in rare instances, no new evidence can be presented during the appellate … [Read more...]

July 13, 2014 by Kevin Mahoney

violent crime

Unfortunately, violent crimes occur every day all across the United States. If you are the victim of a violent crime you are likely scared, confused, and worried about further violence from the assailant if the assailant remains at large. These fears are often increased if the identity of the assailant is unknown. Of course, you should report the crime to law enforcement immediately. After that, there are some additional steps you should take to decrease the chance of a repeat attack. A violent … [Read more...]

Under Investigation for Federal Offense but Not Charged – Should You Contact an Attorney?

July 13, 2014 by Kevin Mahoney

under investigation

People frequently make the mistake of assuming that they do not need a criminal defense attorney unless, and until, they have actually been charged with a criminal offense. Nothing could be farther from the truth – particularly if you are under investigation for a federal offense. Although both the offenses and the prosecution of those offenses are fundamentally similar at both the state and federal level, the investigation stage of a crime is markedly different at the federal level. An … [Read more...]

Is Consent a Defense to Sexual Assault or Statutory Rape?

June 14, 2014 by Kevin Mahoney

In Massachusetts, being charged with a sex crime is a serious matter and should be treated as such from the moment you are charged or you feel you are the target of an investigation. If convicted, you could face a lengthy term of incarceration, be required to register as a sex offender for life, and have to live with the social stigma attached to those who have been labeled a “sexual predator.” Like all criminal charges, sex offense charges can be resolved by way of a plea agreement. … [Read more...]

    Attorney Mahoney,

I just wanted to say thank you for such a wonderful and excellent job you did for me. You were quite impressive up there and you really did your homework catching her in a few lies from previous testimony. You are the best! Even though I never want to be in this situation again, if I know anyone I will give them your name.

Thank Amy for me too! She is a great asset to have in your office! Very pleasant and understanding.

Again thank you and go Celtics!

Kevin Mahoney recently represented me in a case for destruction of property and disorderly conduct. He was extremely thorough and persistent, and despite a great deal of evidence against me, he managed to get the felony charge dropped without having to go to trial.

I had never been in legal trouble before and had no idea how to proceed, and without his counsel, I am sure that I would have gotten convicted.

He listened to my specific needs and always acted in my best interest. His knowledge, attention to detail, and general courtroom presence continued to amaze me throughout the entire process.

    Attorney Mahoney,

Is very knowledgeable and very professional. He has just represented me in a case lasting a year and a half, and he made sure I got a fair trial with a fair jury. He kept me well informed about what would be happening in the court room and always had a well thought out defense for any route of attack the D.A. would be planning on.

My trial took 2 and a half days and after the jury deliberated for approximately 23 minutes they came back with a “Not guilty” verdict. I would recommend Attorney Mahoney to anyone I know, but I sure hope I dont need him again. : ) .
