Defense of Internet Crimes

While law enforcement at all levels have intensified their efforts to uncover cyber-crimes and identify and ensnare those responsible using traditional investigative techniques augmented by some of the most advanced and sophisticated internet investigative methods, many of the “cyber-crimes” with which individuals are now being charged can be successfully defended.

State and Federal prosecutors must not only overcome constitutional and institutional impediments to obtaining indictments and convictions, they face the additional hurdle of applying often outdated statutes to novel Internet activity. Further, U.S. law enforcement efforts are bedeviled by the transnational scope of cyberspace, jurisdictional difficulties, inadequacy of international cooperation, and at times the absence of cyber-crimes laws in the “host” country.

Given the damage a single “hacker” can inflict on businesses, corporations, and their customers, as well as the overall dampening effect on consumer confidence in the security of their information, governments worldwide have been responding with more severe and expansive laws to combat Internet generated crime. The FBI and State and local police departments’ commitment to investigating and prosecuting so called cyber-crimes cannot be understated. Because of surging Internet use, and the concomitant rise in Internet related crimes, the FBI has formed a Computer Crimes Task Force and created the Internet Crime Complaint Center to field accusations of Internet crimes.     Kevin Mahoney recently represented me in a case for destruction of property and disorderly conduct. He was extremely thorough and persistent, and despite a great deal of evidence against me, he managed to get the felony charge dropped without having to go to trial.

    Attorney Mahoney,

    Is very knowledgeable and very professional. He has just represented me in a case lasting a year and a half, and he made sure I got a fair trial with a fair jury. He kept me well informed about what would be happening in the court room and always had a well thought out defense for any route of attack the D.A. would be planning on.

    My trial took 2 and a half days and after the jury deliberated for approximately 23 minutes they came back with a “Not guilty” verdict. I would recommend Attorney Mahoney to anyone I know, but I sure hope I dont need him again. : ) .
